How this works

Appointment and referral are within 7 days of notice (HGCRA s.108(2)(b); Scheme Part I para 7(1)). Nominating bodies communicate selection within 5 days of receiving a request (para 5(1)); an adjudicator indicates willingness within 2 days of receiving their request (paras 2(2), 5(3)). These are separate clocks, not extra time after the 7-day referral period.

The decision is due within 28 days of referral, 42 with referring-party consent, or a longer period agreed by both parties after referral (s.108(2)(c)–(d); para 19(1)). E&W and Northern Ireland use receipt of the referral; the Scottish text uses the date of the referral notice. In Northern Ireland the same rules come from article 7 of the 1997 Order and the NI Scheme as amended from 14 November 2012.

Clerical or typographical errors arising by accident or omission can be corrected within 5 days after delivery of the decision (s.108(3A); E&W para 22A(2); Scottish para 22A(2) inserted by SSI 2011/371 reg.3(3)). It is not an extension for deciding the dispute.

Periods start the day after their trigger. Christmas Day, Good Friday and the relevant nation’s bank holidays are excluded; weekends count (s.116(2)–(3)). A compliant contractual procedure such as NEC W2, TeCSA or CIC has its own timescales instead.

FAQs

When must I refer the dispute?

Within 7 counted days after the notice of adjudication under Scheme Part I para 7(1). Appointment and referral must fit that timetable.

Does nomination start on the notice date?

No. The body’s 5 days run from receiving its request; the adjudicator’s 2 days run from receiving their request. Enter those actual dates.

Can the decision deadline be extended?

28 days normally; 42 with referring-party consent; a longer period agreed by both parties after referral.

Does the slip rule allow changing the merits?

No. The 5-day rule concerns clerical or typographical errors arising by accident or omission, measured from delivery of the decision.

Does this replace NEC W2 or another contract procedure?

No. A compliant contractual procedure such as NEC W2, TeCSA or CIC has its own timescales, which apply instead.
